Warrant of Execution Issued for Mr. Landrigan

The Arizona Supreme Court granted the state’s motion today for a warrant of execution in Mr. Landrigan’s case.  The FPD expects the actual warrant with dates to be issued tomorrow.  Please visit the FPD’s website to get up to speed on the Landrigan litigation.  www.fpdaz.org/CHU-Landrigan.html.  Currently, there is a nationwide shortage of the lethal injection drug sodium theopental.  The Court has indicated Mr. Landrigan may request a stay of execution if the state is unable to procure the drug within the time frame set by the execution warrant.

9th Circuit Win!

On Friday, the 9th Circuit granted penalty phase relief in Detrich v. Ryan.  Mr. Detrich was represented by the Project’s own Jen Bedier, as well as Greg Kuykendall.  Congrats to the team!

Notably, Mr. Detrich’s sentencing counsel fulfilled his duty under the ABA Guidelines to facilitate the work of habeas counsel, which undoubtedly played an important role in this resolution.

Arizona Supreme Court Vacates Death Sentence

The Arizona Supreme Court has affirmed the conviction and vacated the death sentence in State v. Snelling.  On independent review, the Court found insufficient evidence to uphold F6, the sole aggravating factor in the case.  This is the third grant of relief in a capital case by the Arizona Supreme Court this year.

Arizona Supreme Court Affirms Death Sentence

The Court has affirmed the conviction and sentence in State v. Chappell.  Because the Court denied relief on all claims, it also denied as moot the state’s cross-appeal challenging the trial court’s ruling that the defense is not required to disclose the mitigation specialist’s notes from witness interviews.  Read the opinion below.
