On Friday, the 9th Circuit granted penalty phase relief in Detrich v. Ryan. Mr. Detrich was represented by the Project’s own Jen Bedier, as well as Greg Kuykendall. Congrats to the team!
Notably, Mr. Detrich’s sentencing counsel fulfilled his duty under the ABA Guidelines to facilitate the work of habeas counsel, which undoubtedly played an important role in this resolution.
The Arizona Supreme Court has affirmed the conviction and vacated the death sentence in State v. Snelling. On independent review, the Court found insufficient evidence to uphold F6, the sole aggravating factor in the case. This is the third grant of relief in a capital case by the Arizona Supreme Court this year.
The Court has affirmed the conviction and sentence in State v. Chappell. Because the Court denied relief on all claims, it also denied as moot the state’s cross-appeal challenging the trial court’s ruling that the defense is not required to disclose the mitigation specialist’s notes from witness interviews.
